Competition Authority Opens Probe into Wood Coating Firm Over Alleged Price-Fixing

The Turkish Competition Authority has initiated a formal investigation into Hemel Boya Kimya ve Sanayi AŞ, a company operating in the wood preservation, maintenance, and paint industry, over suspected violations of competition law.

    According to a statement, the probe stems from claims that the company may have breached Article 4 of Law No. 4054 on the Protection of Competition by engaging in practices such as fixing resale prices and limiting the ability of resellers to conduct online sales. These types of activities, if proven, could constitute anti-competitive behavior under Turkish law.

    The Competition Board had initially opened a preliminary inquiry on May 15, 2025, following complaints related to Hemel’s commercial practices. This inquiry was authorized through the Board’s decision numbered 25-19/462-M. Per a statement issued by the authority, the evidence collected during this initial phase was deemed both significant and sufficient to warrant a deeper investigation.

    As a result, the Board, during its meeting held on June 26, 2025, voted to proceed with a formal investigation into the company. The decision to move forward was recorded under decision number 25-23/548-M.

    The investigation will further examine the company’s conduct to determine whether it unlawfully restricted competition through its relationships with resellers. The findings of the probe could lead to potential penalties if the company is found in violation of competition rules.
