The Competition Commission of India (CCI) has dismissed a case of abuse of dominance alleged against Amazon Sellers Service by Dutch brand Beverly Hills Polo Club (BHPC) on Friday, September 11.
According to the order, BHPC, the informant, claimed that Amazon Sellers Service, through its dominance of the online fashion retail space and together with its affiliates Amazon Exports Sales and Couldtail India, created unfair market conditions and barriers to entry to the relevant market in India.
The informant stated that the online marketplace amazon.in was selling counterfeit, unauthorized, and unlicensed products of BHPC brand at as much as three times less than the price of the original products.
Further, it stated that Amazon provided deep discounts on products being sold through its preferred sellers, Amazon Exports and Cloudtail, while giving them higher search rankings and ensuring better customer reviews, thus foreclosing competition within the suppliers market as well.
