A special consumer rights court in Warsaw has sided with the UOKiK in its action against UEFA for the sale of Euro 2012 tickets. Poland’s competition watchdog had brought its action against UEFA in August 2011 for imposing conditions on the tickets that violated consumer protection laws. The court found that 19 of the 25 contested contractual clauses harmed consumers and prohibited their exercise. Such clauses include excluding UEFA from liability for delays in tickets delivery; allowing for changes in essential contract terms, such as the date, time, location of matches, as well as the consumer’s seat, and; setting Switzerland as the forum for all disputes between consumers and UEFA.
