Spain’s Watchdog Presents Guidelines For Competition in Public Sector Contracts
The National Commission for Markets and Competition (CNMC) has recently approved the Communication 1/2023 of 13 June on the criteria that determine the prohibition of companies that distort competition when entering into contracts with the public sector.
This new measure was adopted in accordance with the Spanish Competition Act in order to tackle distortions of competition by imposing restrictions on companies involved in an infringement of Competition Law.

The criteria established by CNMC include the exemption from the prohibition of contracting with the Public Sector in certain circumstances, such as being leniency applicants or proving the efficient implementation of an antitrust compliance program.
