Australian Competition and Consumer Commission head Rod Sims took a look at the bright side of defeat when speaking at a Law Council of Australia dinner last Friday as he told attendees that, while the ACCC must recognize it will not win every case, the regulator “must be willing to take these cases on.” Further, said Sims, such losses will lead to a more enlightened regulator. While the ACCC is embracing the occasional defeat, Sims says the regulator currently wins about 80 percent of cases initiated in court. While promoting the ACCC’s latest focus on infrastructure, highlighting the NBN Co monopoly, Sims vowed to continue the fight against competitive behavior despite the threat of defeat: “We wont back away from the big companies for fear of losing,” he said. “Our record this year speaks to that.”
