Deutsche Boerse has asked the EU General Court to overturn the European Commission’s decision to block its proposed merger with NYSE Euronext. According to its filing, the Commission “failed to properly assess” the offer to sell NYSE Euronext’s BClear single equity derivatives business to resolve antitrust concerns. Moreover, Deutsche Boerse argued, the efficiencies that would have resulted from the merger would offset anticompetitive effects.
