French Competition Authority Orders Meta Back to Negotiating Table in Publisher Payment Dispute

    According to Reuters, the French Competition Authority ordered Meta to present a payment framework within 15 days and resume discussions with media associations DVP and APIG, which allege they have gone unpaid for the use of their journalistic content since 2025 after a previous licensing agreement expired in 2024.

    The watchdog said its preliminary assessment indicates that Meta may have abused its dominant market position during negotiations by attempting to impose its own methodology for calculating payments while withholding information publishers considered necessary to determine appropriate compensation. Reuters reported that the regulator viewed those practices as potentially anticompetitive, prompting interim measures designed to restore negotiations.

    The dispute centers on the European Union’s “neighboring rights” framework, which allows news publishers to seek payment when digital platforms reuse or display portions of their journalistic content. France has been among the most active EU member states in enforcing those rules, using competition law alongside copyright legislation to encourage licensing agreements between technology companies and news organizations.

    Meta said it disagrees with the French authority’s conclusions but intends to continue participating in the process. In a statement cited by Reuters, the company said it remains committed to reaching what it described as a fair agreement with DVP and APIG and expressed hope that the regulator’s decision would help advance negotiations.

    DVP, whose members include major French newspapers such as Le Monde and Les Echos, welcomed the regulator’s intervention, saying the decision should help restart discussions over compensation for publishers’ content, according to Reuters.

    Competition concerns remain central

    The case highlights the increasingly prominent role of competition authorities in disputes between digital platforms and content creators. Rather than determining the amount Meta should pay, the French Competition Authority deliberately avoided setting a provisional figure, arguing that doing so could distort the bargaining process.

    Reuters reported that Authority President Benoît Cœuré said assigning a specific amount could create an artificial reference point that would influence negotiations instead of allowing the parties to reach their own agreement.

    The regulator said the absence of payments since 2025 has caused financial harm to member publishers while their news content has continued to appear across Meta’s services.
