Welcome to the November issue of “From Collusion to Competition.” This month’s column covers recent US Congressional hearings on cartel enforcement and screening.
The US Senate Committee on the Judiciary Subcommittee on Antitrust, Competition Policy and Consumer Rights recently held a hearing on cartel prosecution that should be of interest to everyone concerned about price-fixing cases, including potential LIBOR ones. The panel was a distinguished one, including from the government William Baer, Assistant Attorney General (Antitrust Division) and Ronald Hosko, Assistant Director, Criminal Investigative Division, FBI. Front and center were detection issues and the value of screens. Written testimony and the webcast of the hearing are available here.
I am happy to see that screens are now regularly part of discussions on cartel detection, and I believe that their importance can only grow further over time.
