Unexpectedly, without the Hellenic Competition Commission being consulted or even notified, an amendment to L. 3959/2011 has been tabled. “On the Protection of Free Competition” (Greek Competition Act) incorporated in an irrelevant draft law, which is to be discussed in today’s plenary session of the Greek Parliament. The proposed amendment, introduced under a fast-track procedure, does not satisfy the conditions of good law-making process and is a severe blow to the Authority’s independence.
Furthermore, the proposed provisions, apart from being partly photographic in nature, reverse the Authority’s long course towards independence and raise serious issues as to the effectiveness of its operation. For that reason, the HCC, under its institutional role requests (with one of its members’ minority vote) that the proposed amendment be withdrawn.
