Brazil: Regulator to consider TIM’s appeal against Nextel acquisition

Brazil’s Administrative Council of Economic Defense (Cade) accepted the appeal filed by TIM in October against clearance of Nextel’s takeover by Claro’s owner America Mobil. TIM asked for the application of remedies to neutralize a possible excessive market concentration.

    In TIM’s view, the merger of the companies will create an imbalance in the Brazilian telecommunications market because it will allow Claro group to accumulate a very large amount of spectrum. As a remedy, TIM asks Cade to establish Claro’s obligation to share part of the spectrum with competitors, at cost price.
