Peru: INDECOPI eliminates prohibition on private cars for tourist services

The Specialized Chamber for the Elimination of Bureaucratic Barriers at Peru´s market regulator INDECOPI has marked as an illegal bureaucratic barrier the prohibition on category M1 vehicles (cars or station wagons) from rendering transportation services for individuals, striking a blow to a resolution by the Ministry of Transport and Communications.

    The pronouncement by INDECOPI is based on the fact that, although this prohibition has been imposed by the Ministry, it must be borne in mind that the imposition means a change in the conditions within the transportation market, which is why it is the Ministry’s responsibility to present a valid justification.

    Finally, the Special Chamber for the Elimination of Bureaucratic Barriers highlighted that any solution at the regulatory level that is proposed by the authorities, including the MTC, must have a prior justification as long as it implies a modification of market conditions.
