Spain: CNMC fines construction companies for illegal sharing of information

Spanish competition regulator CNMC announced the start of a case against construction companies Acciona Construcción, Corsán-Corviam Construcción, Dragados, FCC Construcción, Ferrovial Agromán, OHL and Sacyr Construcción for possible anti-competitive practices in Public tenders.

    The practices that have attracted the regulator’s attention would include agreements and exchanges of information between the aforementioned companies in order to restrict competition in tenders held by various government administrations for the construction and rehabilitation of infrastructure and buildings.

    The infractions would have had a special impact on the preparation of their technical offers for such bids and would have been implemented, among other ways, by establishing a stable and formal group constituted by the aforementioned companies.

    It is worth mentioning that the aforementioned practices were detected during the investigation of another unrelated file, so the CNMC had to incorporate the information into a separate file, under which new surprise inspections were made to the aforementioned companies.
