According to a filing with the Securities and Exchange Commission (SEC) signed by Henry Schein’s General Counsel, Henry Schein, Patterson Companies, and Benco Dental Supply Company have signed a settlement agreement in In Re Dental Supplies Antitrust Litigation.
The filing only listed the settlement amount of Henry Schein, but did state that all three companies are settling. Schein agreed to a settlement of US$38.5 million.
The case, which was filed in the US District Court for the Eastern District of New York in 2016, alleges that the three companies violated antitrust rules by fixing prices on dental equipment and supplies, as well as other claims. The companies reportedly worked together to fix prices, allocate customers, and foreclose competitors by boycotting manufacturers, state dental associations, and others that deal with defendants’ competitors.
This case was separate from a February complaint filed by the Federal Trade Commission against the three companies similarly alleging violations of US antitrust law.
