Emma Chemicals filed a class-action lawsuit against several manufacturing companies, citing alleged antitrust violations and unjust enrichment.
Lead plaintiff Emma Chemicals filed a complaint in the US District Court for the Eastern District of Pennsylvania against BASF SE, BASF Corp, Bayer AG, Bayer Corp, Bayer MaterialScience, Covestro, Dow Chemical, Huntsman International, Huntsman Corp, Mitsui Chemicals America, Mitsui Chemicals, Mitsui Chemicals & SKC Polyurethanes Inc, MCNS Polyurethanes USA, Wanhua Chemical (America), and Wanhua Chemical Group, claiming the defendants violated both the Sherman Act and the Clayton Act.
According to the complaint, Emma Chemicals and the class members purchased products from one or more of the defendants, but the defendants allegedly conspired to fix the prices of the products in question.
Emma Chemicals said the defendants allegedly conspired to limit the supply of methylene diphenyl diisocyanate, used primarily in the production of rigid polyurethane foams, and toluene diisocyanate, used in the production of polyurethanes which are primarily used in flexible foam applications, in the market to raise the price and overcharge buyers.
