Chile: FNE reacts as Tissue case returns

More than two years after the landmark case of collusion in the tissue paper market had seemingly concluded, a new possible complication in the case has been revealed. According to a report by Radio Bío Bío, the cartel also affected a third sector: the institutional clients segment. These may include considerable tenders with hospitals, clinics, restaurants, hotels, large companies and even public bodies.

    The FNE, led by Felipe Irarrázabal, argued that the agency “investigated possible illegal behavior in the two channels through which this type of product is distributed: mass consumption and institutional.” He indicated that the first segment represents between 70% and 80% of the sector’s sales.

    The entity stated that the accusation did not include possible infractions in the institutional channel, because “neither in the evidence seized nor in the multiple statements taken from executives did antecedents appear in addition to those provided by CMPC regarding the existence of an agreement with SCA to allocate customers in this channel. ” He added that “the evidence did not give an account of an agreement subsequent to 2009 or that had effects beyond that date”.
