Peru: Demand for medical exams is illegal, says competition watchdog

Peruvian competition watchdogs INDECOPI have declared that the requirement made for pre-labor medical exams to be carried out in every company is illegal, and applies only to activities that involve risk. The review is part of the agency’s official program meant to eliminate bureaucratic barriers for companies.

    The agency clarified the requirement, which appears in the Workplace Health and Safety Law’s Operating Manual, and which violates the law by imposing a requirement that goes beyond what is stated by the very same law, which requires medical exams only when the activities to be pursued are considered high-risk.

    The agency’s Bureaucratic Barriers commission has now ordered the Labor Authority to cover all the costs arising from these requirements, preventing an unnecessary burden from illegal requirements from reaching employers once the decision is ratified by INDECOPI’s tribunal.
