US: Airlines request dismissal of German company’s lawsuit

The defendants of a cargo airline price fixing suit moved for a dismissal last Friday. The logistics division of German railway company Deutsche Bahn, Schenker AG, sued seven foreign cargo airlines for price fixing in August 2014. This suit was the latest in the series of suits and investigations into the cargo airline industry since 2006 when US Department of Justice launched an investigation. Since 2006, the industry has paid over a billion dollars in settlement fees within the US and billions more to international competition agencies.

    All Nippon Airways Co., Ltd. and Cargolux Airlines International S.A. filed for dismissal in Eastern District of New York court claiming that Schenker filed within the US, despite being a German company owned by the German government. Other claims for dismissal include that the statute of limitations on the allegations expired in 2010 and that Schenker opted out of the middle-district class action against the airlines in May 2011.
