US: Express Scripts faces further legal woes

Express Scripts is facing an antitrust/contract breach lawsuit following its termination of a contract with CareMed last October. Express Scripts pled guilty to fraud after a complaint from US Attorney for the Southern District of New York that from 2009 to 2012 it made false statements to insurance companies to secure prior authorization for the coverage of drugs. Express Scripts then paid $10 million and implemented safeguards.

    On October 24, Express Scripts terminated its contract with CareMed saying it “plead [sic] guilty to fraud,” according to the lawsuit, though CareMed says it was not criminally charged. CareMed states in its lawsuit that there is no legal reason for contract termination and several other pharmacies have sued Express Scripts for terminating their contracts and for denying their claims. Express Scripts has released no comments yet concerning the lawsuit. “
