India: High Court spares BMW from antitrust fines – for now

The Madras High Court is reportedly asking the Competition Commission of India not to impose sanctions on luxury carmaker BMW, at least until BMW can make its plea to contest the CCI’s earlier decision to fine several car companies.

    The CCI ruled last August to fine BMW and 13 other automakers for harming competition by not selling spare parts in the open market. Mercedes-Benz, Hyundai and Nissan were among the sanctioned.

    But three of the companies, including BMW, challenged the order at the Delhi High Court. In turn, the Court stayed one fine imposed against Maruti Suzuki, and had asked BMW and Mercedes-Benz to move the case to the Madras High Court, which had already been hearing a separate challenged to the CCI ruling.

    The Madras High Court has now asked the CCI not to impose fines against the carmakers until their case can be heard, according to reports.
