New Zealand: Chorus defeated in broadband pricing appeal

New Zealand broadband operator Chorus has reportedly lost an appeal of a decision by the nation’s Commerce Commission to cap copper broadband prices.

    Reports say the Court of Appeal has upheld an earlier High Court ruling that backed the Commission, which limited the prices Chorus would be allowed to charge for copper broadband connections. The price cap is set to take place later this year.

    Chorus had appealed the Commission’s decision and argued that the watchdog did not give sufficient weight to a clause in the Telecommunications Act that requires the authority to consider investors’ incentives “to innovate in new telecommunications services.”

    Chorus said it was disappointed in the ruling. Its shares fell 1 cent in the country following the Court of Appeal’s announcement.
