A Japanese court has reportedly ruled against South Korean smartphone maker Samsung, finding that the company did unfairly demand excessive royalties to license its essential patents to Apple.
According to reports, The Tokyo District Court found Samsung used its standard essential patents regarding the 3GPP mobile standard as leverage to receive unfair licensing fees from its rival Apple in violation of FRAND agreements. The court also found Samsung used those standard essential patents to win an injunction against iPhone 4 sales in a case in Japan similar to one brought by Samsung with the US International Trade Commission.
But the Japanese court found that Samsung unfairly won the sales injunction and has therefore capped the company’s licensing demand fees at $95,000, report say.
Apple reportedly expected the pay that amount to license the patent under FRAND terms.
The two smartphone rivals continue to proceed with litigation across the globe regarding the licensing of each others’ patents; similar cases were filed in the US, EU and elsewhere.
