Ecuador: Tribunal halts $138M fine against top telco

A $138 million fined against Ecuador’s largest telco for anticompetitive conduct has been suspended, say reports.

    The fine lodged against Claro Ecuador, owned by Mexican giant America Movil, was first imposed by competition regulator SCPM following complaints the telco abused its dominant market position, alleged by rival CNT.

    Specifically, CNT said its competitor used exclusivity contracts when renting out its infrastructure.

    According to regulators, Claro recognized its misconduct, but appealed the fine on the grounds it was disproportionate. Guayaquil’s district tribunal reportedly agreed and suspended the fine, though the SCPM said it has not received any notification of the court’s reported decision.
