Australia: ACCC overhauls merger reviews

The Australian Competition and Consumer Commission released its draft Merger Review Process Guidelines, requesting public comment on the proposed changes. Among significant altercations to the policy includes a new pre-assessment process to expedite merger review, as well as an implemented process for the ACCC to offer feedback and concerns to parties involved in a proposed merger. Further, the draft changes include a streamlined process for the ACCC to publically publish its reasoning for decisions made. According to ACCC chairman Rod Sims, the proposed changes are aimed at “improving efficiency and transparency” within the regulator.
