US: Intel becomes first to cite SCOTUS class action decision

Just two days after the US Supreme Court offered its decision in Comcast v. Behrend, which upped the requirements for class action certification, Intel Corp. has cited the Court’s ruling in its own antitrust case. Intel is accused of abusing its dominant position in the microprocessor market, barring rivals from entering competition. Plaintiffs are seeking class action certification, but Intel has used the very recent Supreme Court ruling to argue that – as was found in the case against Comcast – that customers have not offered consistent theories in regards to their allegations. If class certification is granted in the Intel case, the company faces millions of computer consumers whose products included the chips.
