In just a matter of weeks the Competition Amendment Act will become effective, and experts say it will offer new strength to South Africa’s Competition Commission. According to reports, the implementation of the new legislation will affect the authority’s ability to investigate markets; experts say it will allow the Commission to launch an investigation into the private healthcare sector, which has been a hot topic as murmurs of anticompetitive behavior in the sector grow. Other provisions of the Act however, such as those pertaining to criminalizing cartels, will not yet go into effect.
