US: Dow scrambles to avoid treble damages of $1.2 billion

Dow Chemical Co., which was fined $400 million in a lawsuit against the company accused of fixing urethane prices, is now asking the judge to dismiss the fine. According to reports, Dow claims there is no evidence to support the claims against the company. The fines are subject to triple under US antitrust legislation, resulting in a $1.2 billion fine. Dow filed its appeal in Kansas City court last Tuesday, arguing that some who participated in the class action suit “were not injured at all.”
