Bulgaria: EU refers broadcast spectrum distribution case to Court of Justice

The European Commission has posted a press release stating that the antitrust authority will refer Bulgaria to the EU’s Court of Justice over Bulgaria’s assignment of digital broadcast spectrum. According the Commission, the authority found that the spectrum assignments were disproportionately awarded and excluded some candidates from earning spectrum. The Commission explains that under the Digital Agenda, the authority has presented guidelines to distributing spectrum in an effort to encourage competition in the market as it transitions from analogue to digital broadcasting; the Commission has found that Bulgaria did not comply with those guidelines.
