South Africa: Tribunal dismisses appeal of liquid fuel cos’ legislative exemption

South Africa’s Competition Tribunal has dismissed an appeal filed by Gas2Liquids, which imports petroleum products, over the Competition Commission’s decision to exempt the members of the South African Petroleum Industry Association from the jurisdiction of the Competition Act. The exemption was granted in 2011 after various cooperation agreements were made; those agreements, the Commission says, ensure competition in the liquid fuel market. Gas2Liquids appealed the exemption, arguing that it is anticompetitive for smaller companies not part of the Association. The Tribunal has ruled that Gas2Liquids’ argument had no merit.
