South Africa: Reversal of merger approval between Paarl Media and Primedia@Home leads to challenges, new legal precedent

In response to the Competition Commission’s reversal of its approved merger of Primedia@Home and Paarl Media, the Tribunal has ordered the Commission to appoint a trustee to help the two businesses unbundle the merger, a process currently without legal precedent or guidelines as to how the process should occur. Among other demands, the Tribunal has ordered Paarl Media to not dispose of assets or cede, transfer or terminate contracts of existing customers acquired under the merger.
