CNC publishes report of its concerns with the National Markets and Competition Commission draft legislation

The National Competition Commission has published its report on a bill that would create the National Markets and Competition Commission. In its report, the CNC voices concerns with the lack of input into the drafting process–it points out that unlike the transparent process for the Spanish Competition Act 15/2007, the voices of other government bodies, interested parties, and stakeholders were missing from the debate.

    Other issues that the CNC would like to see resolved include an institutional structure that “guarantees the functional separation of the investigating body from the decision-making body when dealing with enforcement proceedings,” keeping competition advocacy functions, the funding model and its implications on government independence, and establishing what will happen during the transition period to the CNMC.
