The ACCC has “declared” the wholesale ADSL service, establishing a regime for regulated access to fixed-line broadband internet services. Under the Competition and Consumer Act 2012, an access service provider of the declared service must also supply the service, upon request, to service providers in accordance with standard access obligations. The declaration will require Telstra, the dominant access service provider, to open up access to its national ADSL network to competitors.
The ACCC’s interim access determination sets price terms for the monthly per-user access charge and the monthly charge for data aggregation; these terms and conditions of access will be in effect for the next 12 months, until the ACCC completes its final access determination.
