High Court dismisses Ngwane Mills’ application to stay Competition Commission’s bakery merger approval

The High Court has dismissed Ngwane Mills’ application to stay the Competition Commission’s conditional approval of a merger between Premier Swazi Bakeries, Swaziland United Bakeries, and Sinkhwa SeMaswati Limited. The court found that Ngwane Mills lacked standing to seek a stay of the merger or to appeal it because Ngwane Mills was not a party to the merger proceedings. For Ngwane Mills to have become a party to the merger proceedings, the proper procedure would have been to file a complaint pursuant to Regulation 12(2) of the Competition Commission Regulation.
