The Department of Justice may initiate a probe in the coming weeks, according to Bloomberg, which cited people familiar with the matter. However, no final determination has been made, and the administration could ultimately decide not to proceed, per Bloomberg. The people familiar with the discussions spoke on condition of anonymity because the deliberations are private.

According to Bloomberg, one area under scrutiny involves how market information is circulated within Leading Builders of America, an industry trade association whose members include Lennar Corp. and DR Horton Inc. Officials are said to be examining whether the group’s structure or information-sharing practices could potentially enable companies to limit housing supply or align pricing strategies, per Bloomberg.

The White House declined to provide details, with a spokesperson directing inquiries to the Justice Department. The Department of Justice declined to comment, according to Bloomberg. Representatives for the companies and the trade organization did not immediately respond to requests for comment.

Financial markets reacted swiftly to the news. The S&P Composite 1500 Homebuilding Index erased earlier gains and fell as much as 1.4%. Lennar and DR Horton were among the weakest performers in the index during midday trading, according to Bloomberg.

The administration’s scrutiny comes at a time when homeownership costs are at some of the highest levels seen in decades. The rapid rise in home prices during the pandemic-era housing surge, followed by elevated interest rates, has significantly increased borrowing costs for buyers. At the same time, builders are grappling with rising inventories of unsold homes, adding to the industry’s uncertainty, per Bloomberg.

President Donald Trump signaled heightened attention toward the sector in October, drawing a comparison between major homebuilders and The Organization of the Petroleum Exporting Countries in a social media post.

“It wasn’t right for them to do that but, in a different form, is being done again — This time by the Big Homebuilders of our Nation,” Trump wrote. “They’re my friends, and they’re very important to the SUCCESS of our Country, but now, they can get Financing, and they have to start building Homes.”

Even as the potential investigation looms, homebuilders have reportedly explored ways to collaborate with the White House to expand supply and ease affordability pressures. One proposal under discussion is a large-scale initiative referred to as “Trump Homes,” which could aim to add up to 1 million new housing units, Bloomberg previously reported.
