Crypto Regulation Push Raises Stakes for Competition With US Banks

Senate Majority Leader John Thune took procedural action Saturday to advance the Clarity Act, setting up a key vote after lawmakers return from their August recess, according to Reuters. The maneuver could ultimately clear the way for the legislation to reach a full Senate vote.

The measure would establish broad federal rules governing digital assets, including standards for determining when tokens fall under securities or commodities law and which agencies are responsible for overseeing them, Reuters reported. Crypto companies have argued that clearer federal rules would reduce legal uncertainty and encourage wider adoption of digital assets.

The Senate arithmetic remains difficult. According to Reuters, the bill would need 60 votes to advance, meaning Republicans would require support from at least eight Democrats if all voting Republican senators back the legislation. Democratic opposition has persisted as negotiations continue over provisions addressing crypto interests held by government officials.

The debate also carries implications for competition between traditional banks and digital-asset companies. Banks have opposed provisions that could permit crypto businesses to offer rewards tied to customers’ stablecoin holdings, potentially allowing those firms to compete more directly for deposits, according to Reuters.

That dispute illustrates how Washington’s effort to regulate crypto is increasingly intersecting with competition across the financial sector. Digital-asset companies are seeking rules that allow them to expand products traditionally associated with banks, while established lenders are pushing lawmakers to prevent regulatory differences from giving crypto rivals an advantage.

Passage would represent another significant policy victory for Trump and the crypto industry. Reuters reported that Trump has made digital-asset legislation a priority during his second administration and that the White House has pressed for the Clarity Act. Trump previously signed legislation establishing rules supporting dollar-backed stablecoins.

The administration’s crypto push has also generated scrutiny because of the president’s family business interests. Trump reported more than $1.4 billion in income from his family’s cryptocurrency ventures last year, Reuters reported. Democrats have sought stronger restrictions governing digital-asset ventures involving public officials, and negotiations over those provisions remain unsettled.

The industry has invested heavily in shaping the political environment surrounding the legislation. Crypto interests spent more than $119 million supporting industry-friendly candidates during the 2024 election cycle, according to Reuters, as companies sought congressional action on both market-structure legislation and stablecoin regulation.

For digital-asset companies, the September vote could determine whether years of lobbying produce a comprehensive federal regulatory regime. For banks, regulators and lawmakers, it will also test how far Congress is willing to allow crypto businesses to move into territory traditionally dominated by regulated financial institutions.

Thune’s procedural move indicates Republican leaders believe a path to 60 votes remains possible despite Democratic resistance, Reuters reported. Whether they can assemble that coalition will become clearer when the Senate reconvenes in September.
