Chile’s Free Competition Defense Tribunal (TDLC) has decided to reject the requests for a delay in investigations requested by supermarket chains Cencosud and SMU, as they seek more time to comply with the investigating agency’s information requests regarding their involvement in a price-fixing deal.
The Tribunal pointed out that the arguments presented by the National Economic Prosecutors, the main competition investigating authority, had been “sufficiently clear” and free of contradictions, as had been claimed by SMU’s request.
The TDLC further clarified that the investigations into the case cover a period between 2008 and 2011, “meaning this Tribunal will only be able to sanction any anticompetitive conducts detected to have taken place” during this period, as said by the regulator’s Presiding Minister, Judge Tomás Menchaca.
