Chile: FNE files suit vs. Football Association

Chile’s National Football Association (ANF) is in trouble with the National Economic Prosecutor, which has sued the sporting body over alleged breaches of competition law.

The FNE has raised issues over the incorporation quota of required to join the ‘Primera B’ division, which “affects the competitive capacity of the club which ascends Primera B”. Precisely, this quota was raised to 50 thousand UF (approximately US $ 2.2 million) between 2011 and 2017, down to 24 thousand UF at present.

“The FNE states that the required fee affects the competitive ability of the club that ascends to Primera B, because it forces them to commit future income for a considerable period of time, preventing them from investing in the team under similar conditions to the rest of the clubs in the category” said the Office of the Prosecutor.

In this regard, the FNE has asked the Court for the Defense of Free Competition (TDLC) to force the ANF to bay a fine of about US$5 million for the “damage” it has caused to the promoted clubs.
