Court invalidates FAS ruling on Megafon, MGTS terms

The Moscow Commercial Court has invalidated a Federal Antimonopoly Service decision that determined Megafon had imposed unfair terms on Moscow City Telephone Network (“MGTS”) as part of a takeover agreement in 2008. The terms required MGTS to pay Megafon increased tariffs for zone call completion services for the Moscow network.

The FAS had found these increases to constitute antitrust violations. The Moscow Commercial Court, however, disagreed with the FAS, and ruled that MGTS “had the economic opportunity to use Megafon’s services for the price of 1.02 rubles ($0.03), which did not result in any losses or expenses for MGTS,” according to RAPSI.
