Dutch Court Upholds Antitrust Ruling Against Apple Over App Store Practices

A Dutch court on Monday upheld a decision by the Netherlands’ competition authority, reinforcing earlier findings that Apple engaged in anticompetitive conduct by imposing restrictive conditions on dating app developers in its App Store.

    According to Reuters, the Rotterdam District Court ruled in favor of the Dutch Authority for Consumers and Markets (ACM), confirming the watchdog’s 2021 determination that Apple abused its dominant market position. The court backed ACM’s assertion that Apple had unfairly required dating app providers to use its proprietary payment system, barred them from directing users to external payment alternatives, and charged a commission of up to 30%—or 15% for smaller developers.

    Per Reuters, Apple has expressed strong disagreement with the court’s decision and signaled plans to challenge the ruling. “This ruling undermines the technology and tools we’ve created to benefit developers and protect users’ privacy and security, and we plan to appeal,” a spokesperson told the outlet.

    The dispute stems from an investigation that led ACM to fine Apple 50 million euros (approximately $58 million) in 2021. The penalty was imposed after Apple failed to implement changes the authority had mandated in order to align the App Store’s practices with European Union competition rules.

    Monday’s ruling not only confirms the fine but also strengthens the regulatory pushback Apple has faced globally over the structure of its digital marketplace. The case in the Netherlands mirrors broader scrutiny Apple has encountered in jurisdictions worldwide, as regulators increasingly question the fairness and competitiveness of major tech platforms.
