E.U.: Latest EU guidance on antitrust in auto sector helpful but inconclusive

The recent guidelines published by the EC regarding the auto sector were first appraised (CPI reported). For example, the purchased agent proposal, which allows to pool together to buy spare parts, can be prone to uncertainty. An uncertainty problem could arise because the agent is unknown between the consumers and resellers. Another main concern is the recent position in the German Supreme Court’s dominant position case involving MAN, a truck manufcturing company, where the market definition would enable most importers and manufacturers to qualify for “safe harbors” under the new guidelines.
