EU: DG COMP issues “no deal” Brexit competition law guidance

On Monday, March 25, with only two weeks to go to the newly-extended Brexit deadline of April 12, DG Competition published a Guidance on a “no deal” scenario for the application of EU competition law effective at 00:00h (CET) on April 13, 2019.

    The note provides some guidance on the main implications that can be foreseen of a no deal scenario for the application of EU competition law (antitrust, merger control).

    “Preparing for the withdrawal is not just a matter for EU and national authorities but also for private parties.

    “In view of the uncertainties surrounding the ratification of the Withdrawal Agreement, all interested parties, and especially economic operators, are reminded of legal repercussions, which need to be considered when the United Kingdom becomes a third country.”

    Also on March 25, the European Commission released a Brexit preparedness press statement: “EU completes preparations for possible “no-deal” scenario on 12 April.”

    “As it is increasingly likely that the United Kingdom will leave the European Union without a deal on 12 April, the European Commission has today completed its “no-deal” preparations,” the statement reads.
