EU: ‘Error of law’ may reinstate $132M copper cartel fine

A European Union advisor has suggested that the European Commission may reinstate a $132 million fine imposed on Aalberts Industries NV, accused of partaking in a copper cartel. The fine was overturned by a lower EU court but Advocate General Paolo Mengozzi of the EU Court of Justice announced that “an error of law” occurred when the fine was annulled. The comments were made in a non-binding opinion. The fine was appealed last March; the court advisor said Aalberts were reviewed as individual subsidiaries instead of a company as a whole when assessing exactly how and when Aalberts partook in the cartel.
