EU: ECtHR rules in antitrust fair trial dispute

The European Court of Human Rights has issued a ruling on a long-running case between Slovenian commercial broadcaster Pro Plus and the country’s Competition Protection Agency (AVK), reported RTV Slovenija. Due to a violation of the right to a fair trial, Slovenia has to pay the company €52,500 (US$59,810) in compensation and cover costs of €10,000 (US$11,393).

The right to a fair trial was violated in Pro Plus’s case after the AVK imposed a fine of €105,000 (US$119,621) for alleged obstruction of an investigation. The Slovenian court refused to hear an appeal from Pro Plus regarding a fine for allegedly obstructing a dawn raid. The AVK claims that, from January 1, 2003, to April 24, 2013, Pro Plus abused its dominant position in the TV advertising market.
