France: Authority fines TDF over Eiffel Tower contract

The French Competition Authority has fined broadcast and telecom infrastructure company TDF EUR 5.6 million for anti-competitive behaviour regarding access to the Eiffel Tower for DTT and radio broadcasting.

The case was brought by TowerCast in 2006, claiming that TDF provided late and incomplete information that was necessary for it to make a precise and competitive offer.

The regulator agreed with TDF’s claims and found that TDF imposed a price squeeze on its competitors. TDF said it offered the city of Paris EUR 3.7 million a year to use the site, or twice as much as TowerCast. It added that administrative judges ruled in its favour three times on the case.

The company said it would decide whether or not to appeal the decision once it has analysed the decision.
