FTC asks Solicitor General to file petition for certiorari for SCOTUS review of Phoebe Putney-Palmyra Park merger

The Solicitor General has filed a petition for certiorari with the U.S. Supreme Court to review the 11th Circuit’s ruling on Phoebe Putney’s acquisition of Palmyra. The FTC had filed a complaint to block the merger on March 20, 2011. Phoebe Putney and Palmyra were the only two hospitals in Albany, Georgia. On June 27, 2011, the U.S. District Court for the Middle District of Georgia, Albany Division, dismissed the FTC’s complaint and denied its motion for a preliminary injunction. The 11th Circuit affirmed the District Court ruling on December 9, 2011.

The Solicitor General’s petition is filed on behalf of the FTC. The Commission voted 4-0 to authorize the request.
