Germany: Court backs regulator in Asics sneaker case

Germany’s competition authority said that a national court has upheld its finding that sneaker and apparel maker Asics cannot prevent its distributors from listing on price comparison engines, after determining the infringement was so obvious that the case need not be sent on to the High Court.

On Friday, January 26, the Federal Court of Justice gave the Bundeskartellamt its backing in the fight against restrictions on online trade of tennis shoes. The judges declined to deal with a complaint from the sports shoe manufacturer Asics, who wanted to claim before the court the right to prohibit its dealers the use of price search engines. This practice had already been forbidden to the sports shoe by the Federal Cartel Office.
