Germany: EC snags jurisdiction for cement deal

The European Commission decided not to refer the buyout of cement firm Cemex to German state competition regulators, the authority announced Monday.

The decision means the planned acquisition of Cemex by Swiss competitor Holcim will be reviewed by the Commission, turning down Germany’s request to review the merger.

Despite Cemex’s location in Germany, according to a press release the Commission decided that the geographic scope of relevant markets concerning the transaction go beyond German boarders.

German authorities first requested to review the deal last September on the grounds that the acquisition would significantly affect the German market, claiming the effects were also limited to within the state.
