India: Cement makers find support in appeal of CCI-issued fines

The Minister of State for Commerce and Industry has stated that he will approach the Competition Commission of India with the issue of cement companies getting fined for idle excess capacity, saying that the argument that the excess capacity is due to the economic slowdown and decreased demand “has merit.” Cement producers and their association, the CMA, have recently appealed fines imposed on the producers by the CCI for cartel behavior. Eleven cement makers as well as the CMA were all fined last June, and a twelfth was fined the following month. Those fined brought their appeal to the Competition Appellate Tribunal, which has already begun looking into the matter.
