Ireland: Ryanair forced to sell Aer Lingus stake under Court of Appeal ruling
Ryanair’s battle to keep its stake in Aer Lingus suffered its ninth consecutive court defeat yesterday after the Court of Appeal supported an earlier ruling that the airline must sell its stake in its Irish rival.
Ryanair had appealed an earlier ruling by the UK’s Competition Appeal Tribunal, which had backed a previous UK Competition Commission decision, which had demanded the airline cut its stake in Aer Lingus.
However, the Court of Appeal yesterday threw out Ryanair’s challenge and refused to grant Michael O’Leary, chief executive of Ryanair, permission to appeal to the Supreme Court.
“This finding from the UK Court of Appeal confirms once again Aer Lingus’ position in a longstanding legal battle about the anti-competitive effects of Ryanair’s stake in Aer Lingus”, Aer Lingus’ lawyers at Cadwalader, Wickersham & Taft said in an emailed statement.
