New Zealand: Shippers prep to be stripped of antitrust exemption

As the government mulls a revision to legislation that would strip the nation’s shipping companies of their antitrust exemptions, the companies are reportedly nervously following the developments in preparation for some potentially major changes. The government is looking to make cartelization, as well as other anticompetitive practices, within the shipping industry punishable under competition law. The exemptions have stood for nearly three decades and allowed companies to coordinate on an operational basis for international shipping. The movement to strip the companies of those exemptions is a result of a report by the Productivity Commission, which recommended the action about a year ago.
