Private lawsuit by pharmacy groups mark last-ditch effort to block Express Scripts-Medco merger
In the face of possible FTC approval for the deal, the National Association of Chain Drug Stores, the National Community Pharmacists Association, and nine retail pharmacy companies have filed a private lawsuit in Pennsylvania federal court to block Express Scripts’ acquisition of Medco. CVS, Walgreen, Wal-Mart, Target, and Rite Aid are members of the National Association of Chain Drug Stores. The pharmacy group, along with its co-plaintiffs, argue that the merger would hurt retail pharmacies and large employers.
